Protection of Personal Information

MailUp, Inc. ("MailUp" or "We") provides a multichannel direct marketing system ("MailUp Service" or "Service") that businesses ("MailUp Users" or "Users") use to contact their customers and prospects ("Customers") using email, text messages, and social messages.

MailUp protects all information belonging to any party that granted the Company or Users of the Service permission to contact them, and does not share any such information with any other party.

In connection with the provision of the Service, MailUp collects and stores the following information:

  • Anonymous information from visitors to this Web site
  • Personal information (e.g. name and e-mail address) from visitors to this Web site that subscribe to our newsletter or elect to sign up for a free trial of the Service
  • Detailed personal information (e.g. name, company name, company, address, etc.) from Users of the Service
  • Personal information pertaining to the "Customers" uploaded to the MailUp system by Users in connection with their use of the Service.

Use of Anonymous Information

We use Anonymous Information to run our Company more effectively and improve it over time. For example, we may detect the type of browser you are using and use that information to redirect you to a section of the MailUp Web Site that works best for your browser, and use the same information to increase browser compatibility over time. Similarly, we may attempt to detect your geolocation and direct you to a version of the MailUp Web site that is written in a language that might better match your needs.

We reserve the right to maintain, use, and share Anonymous Information without limitation.


Use of Personal Information

We use the Personal and Anonymous Information you provide when requesting information on the MailUp Service or signing up for a free trial of the Service in order to communicate with you or create a free trial account.

However, the Personal Information you have provided to MailUp may be transferred to another party if all or a share of our Company is purchased by another party.

We never use or share Personal Information in ways unrelated to the ones described in this Privacy Policy, and we will not do so in the future without providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.


Use of Detailed Personal Information

We collect detailed personal information about you and your business when you order the MailUp Service, becoming a User of the Service.

We do not share Detailed Personal Information with outside parties except to the extent necessary to create and manage your MailUp account and billing subscription. For example, we "pass" the credit card information you provide, without storing it, to the payment gateway used by MailUp, which will securely store it and use it to process the recurring payments associated with your MailUp subscription.

However, the Personal Information you have provided to MailUp may be transferred to another party if all or a share of our Company is purchased by another party.

We never use or share Personal Information in ways unrelated to the ones described in this Privacy Policy, and we will not do so in the future without providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.


Use of Customers Information

MailUp does not share with any other party, and does not use for its own promotional activities, personal information that has been uploaded to or otherwise used in connection with the Service by Users of the MailUp Service.

Users of the MailUp Service are prohibited by the Terms and Conditions of Use of the Service from any misuse of the Service that results in the violation of the privacy of the Customers that granted them a permission to contact them. For example, the mailing of unsolicited email messages is strictly prohibited by the MailUp Anti-SPAM Policy.


Commitment to Information Security

Our server farm is located in a highly secure, state-of-the-art data center. MailUp uses security measures - such as storing confidential data in an encrypted format - to avoid the misuse of such data. In addition, MailUp Users agree to comply with a strict rule of conduct with regard to how personal information (e.g. your e-mail address) is handled.

You acknowledge that MailUp has limited control on the ways the MailUp Service is used by a MailUp User. For example, it may take us some time to detect that a User is violating our Anti-SPAM Policy and to block such violation.


Commitment To Children's Privacy

Our Site is not directed to Children. That said, we will not knowingly collect, use or disclose Personal Information from any child under the age of 13.


How You Can Access Or Correct Your Information

If you are a Customer of a MailUp User, please contact that company or see the 'How to Stop Receiving Message' section below.

If you are a User of the MailUp Service, you can change the Detailed Personal Information the Company has on file for your account by logging into your MailUp account. You acknowledge and agree that MailUp may preserve Personal and Anonymous Information, and may also disclose such data if required to do so by law or MailUp determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce the MailUp Terms of Use defined at http://www.mailup.com/terms-of-use.htm, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of MailUp, its employees, users of or visitors to the Site, and the public.

You cannot access your payment information as we do not store it. You can update your payment information through the MailUp billing system and we will contact and update your recurring payment profile with stored by the payment gateway used by MailUp.

How to Stop Receiving Messages

If you receive a message that was sent via MailUp (e.g. you see the MailUp logo in the footer), it means that a business that you have or had a relationship with has become a User of the MailUp Service and your email address or mobile phone number exists in one of the lists they manage from their MailUp account.

If you do not wish to receive additional messages from that business, simply click on the unsubscribe link that should exist somewhere in the body of the email message or reply STOP or END to the text message you received. If you are for any reason unable to unsubscribe, contact the business and let them know that you wish to unsubscribe. If you are still receiving messages after doing so, you can report the case to MailUp by sending a message to abuse@mailup.it. When you do so, please also send a copy of the complaint to the email sender of the unsolicited message.
