In general, any information and data which you provide to MailUp over the Website, or which is otherwise gathered via the Website, in the context of the use of MailUp’s services ("Services") as better defined in Section 3 below, will be processed by MailUp in a lawful, fair and transparent manner. To this end MailUp takes into consideration internationally recognised principles governing the processing of personal data, such as purpose limitation, storage limitation, data minimisation, data quality and confidentiality.
You can contact MailUp’s Data protection Officer ("DPO") at the following e-mail address: firstname.lastname@example.org.
When you use the Website, you may provide to us or we may collect some of your Personal Data , such as your name, an identification number, an online ID or one or more characteristic elements of your physical, physiological, mental, economic, cultural or social identity which allows you to be identified either by itself, or together with other information which has been collected ("Personal Data").
Your Personal Data can be collected by MailUp both when you choose to provide them (e.g., when you ask MailUp for information through the Section “Contact us” of the Website www.mailup.com/contacts, when you subscribe to the newsletter or when you request for a free trial) or simply by analysing your behaviour on the Website.
Personal Data which can be processed through the Website are the following:
In various sections of the Website – including, particularly, when you request for a free trial o when you ask for information relating MailUp’s Services – you will be asked to submit information about yourself, such as your name, phone / mobile numbers, e-mail address, the Company you work for etc. Additionally, whenever you communicate with MailUp through the contact details provided in the Website, MailUp may collect additional information which you choose to provide.
When registering to apply for a position within MailUp at the Section (www.growens.io/en/work-with-us) ("Jobs") you will also be asked to fulfil a form ("Application") in which you may provide various types of Personal Data, including professional/employment details (e.g., university attended, foreign language knowledge, link to your professional profiles on social networks professional qualifications, candidate’s expectations and wished workplace, availability to start), attach your profile pic, your CV and your cover letter).
When receiving a job application, MailUp may assess your professional social media accounts (e.g. LinkedIn) or professional websites, although you did not attach them to the Application, where publicly available, to gain insight as to your suitability for position applied for.
Certain areas of the Website (e.g. the Contact form or the form dedicated to spam reporting) may include free text fields, where you can provide to MailUp information which may contain Personal Data.
Where these fields are completely free, you may use them to disclose (inadvertently or not) more sensitive categories of Personal Data, such as data revealing your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership. The content you upload in these fields may also (inadvertently or not) include other types of sensitive information relating to you, such as your genetic data, biometric data or data concerning your health, sex life or sexual orientation.
MailUp asks that you do not disclose these kinds of Personal Data, unless you consider this to be strictly necessary. Please mind that sensitive categories of Personal Data can be processed with your explicit consent only, in compliance with the current legislation. MailUp underlines the importance to express your explicit consent to process this sort of Personal Data, where you decide to share them.
As mentioned in the previous section, certain areas of the Website allow you to post various types of content, available to MailUp that may include Personal Data related to other persons.
In any situation where you decide to share Personal Data related to other persons, you will be considered as an independent data controller regarding that Personal Data and must assume all inherent legal obligations and responsibilities. This means, among other things, that you must fully indemnify MailUp against any complaints, claims or demands for compensation for damages which may arise from the processing of this Personal Data, brought by the third parties whose information you provide through the Website.
In any case, if you provide or otherwise process Personal Data of third parties when using the Website, you guarantee from now on - assuming all related liability - that that particular processing hypothesis is based on the consent of the third party concerned or on another appropriate legal basis legitimising the processing of the Personal Data of third parties.
When we send e-mail or communications we use tracking systems, with the explicit and freely provided consent of the user, such as pixel or web bacons, in order to detect the opening of a message, the clicks made on hyperlinks contained within the e-mail, from which IP address or with which type of browser the email is opened and other similar details.
The Website’s operation, as is standard with any websites on the Internet, involves the use of computer systems and software procedures, which collect information about the Website’s users as part of their routine operation. While MailUp does not collect this information in order to link it to specific users, it is still possible to identify those users either directly via that information, or by using other information collected – as such, this information must also be considered Personal Data.
This information includes several parameters related to your operating system and IT environment, including your IP address, location (country), the domain names of your computer, the URI (Uniform Resource Identifier) addresses of resources you request on the Website, the time of requests made, the method used to submit requests to the server, the dimensions of the file obtained in response to a request, the numerical code indicating the status of the response sent by the server (successful, error, etc.), and other parameters related to the operating system and user’s IT environment.
These data are used to compile statistical information on the use of the Website, as well as to ensure its correct operation and identify any faults and/or abuse of the Website. Save for this last purpose, these data are not kept for more than 7 days.

On the other hand, "profiling cookies" – i.e., cookies used to create profiles on users and to send advertising messages in line with the preferences revealed by users while browsing websites – typically require specific consent from users, although this may vary according to the applicable law
